Product overview

This customizable agreement covers averaging an employee’s hours of work and banking overtime as paid time off. Each version sets out that jurisdiction’s rules: the overtime threshold and rate, whether averaging needs an agreement or a permit, how much time off each overtime hour earns, how long banked time can be held and what happens when employment ends.

Instant download in Word and PDF, with lifetime access. Also included in Pro and Team memberships.

What's Included
  • Plain-language table of the overtime, averaging and banked time rules for your jurisdiction, with the sections of the Act
  • Part A: averaging period, start and expiry dates, renewals and a week-by-week schedule, or permit details where a permit is needed
  • Part B: banked time choice, rate, time limit, how to book time off or ask for a payout, and payout when employment ends
  • A clear statement in the versions where averaging agreements or banked overtime are not available
  • Employee and employer signatures, an employer record with tick boxes and a Legal note
  • Fillable Word document and a print-ready PDF for each version (3 to 5 pages, depending on the version)
Choose Your Province

Select your province, territory or federal jurisdiction before purchasing. The rules differ widely: in some jurisdictions averaging needs a permit, in others it is not available, and New Brunswick does not allow banked overtime. Each version says what applies. The federal version is for federally regulated private-sector employers under the Canada Labour Code. Not available for Quebec.
